2. ACCEPTANCE OF TERMS
By accessing or using the Platform, you:
– Confirm acceptance of these Terms of Use;
– Acknowledge they constitute a legally binding agreement with MAKlistings.com;
– Represent authority to bind any business entity you act for.
Non-acceptance: Discontinue Platform use immediately if you do not agree.

3. CHANGES TO THESE TERMS
We may amend these Terms without prior notice. The updated version will be posted on this page. Registered users will receive email notifications for material changes (where legally required).
Your obligation: Review these Terms before each Platform use.

4. PLATFORM MODIFICATIONS & AVAILABILITY
– We may change the Platform’s operation, features, or Content without notice to reflect technological advancements, market practices, legal/regulatory requirements, or business priorities.
– We do not guarantee free or uninterrupted access. We may suspend, withdraw, or restrict all/part of the Platform for business or operational reasons.

6. LICENSE TO USE PLATFORM & CONTENT
Subject to compliance with these Terms, MAKlistings.com grants you a personal, limited, non-transferable, non-exclusive, revocable license:
Permitted use:
– Print/download extracts for personal use;
– Share Content with others.
Restrictions:
– Do not modify printed/downloaded materials;
– Do not use media (images/videos/audio) separately from text;
– No commercial use without a MAKlistings.com license.
Ownership: MAKlistings.com owns/licenses all rights (including IP). All rights reserved.
Trademarks: Marks displayed are MAKlistings.com or third-party property. Use requires prior written consent.

7. RESTRICTIONS
You must NOT:
– Use if under 18;
– Use unlawfully;
– Attempt unauthorized access;
– Damage/disrupt the Platform;
– Introduce viruses/malware;
– Impersonate others;
– Engage in harassment;
– Generate spam;
– Exploit Platform/Content commercially;
– Scrape content via bots;
– Reverse-engineer source code.
Consequences: Breaches will be reported to law enforcement.

8. ACCOUNT CREATION
Requirement: Needed for certain features.
Responsibilities:
– Provide truthful information;
– Maintain login confidentiality;
– Notify MAKlistings.com of unauthorized use;
– All activities are your responsibility.
Deletion: Request via support@MAKlistings.com.
Privacy: Handled per Privacy Policy(https://maklistings.com/privacy-policy/).

9. PAID SERVICES & PAYMENTS
Paid Services (e.g., featured Listings):
– Fees are non-refundable;
– No guarantee of Listing success.
Payments:
– You authorize MAKlistings.com to charge your payment method;
– MAKlistings.com is not responsible for insufficient funds.

10. LISTINGS & REVIEWS
Sellers must:
– Be legally permitted to sell;
– Own/be authorized to sell the item;
– Ensure compliance with Acceptable Use Policy(https://MAKlistings.com/acceptable-use-of-policy/);
– Include accurate descriptions;
– Post one item/service per Listing;
– Comply with laws;
– Act lawfully with Buyers.
Buyers must:
– Be legally permitted to purchase;
– Act lawfully with Sellers.
AI Tools:
– Verify accuracy before publishing;
– MAKlistings.com excludes liability for AI-generated Listings.
Reviews/Ratings:
– Must be factual, accurate, and genuine;
– Reflect actual experiences;
– Avoid defamation/inflammatory content.
Liability: Reviews reflect users’ views only; MAKlistings.com may remove non-compliant Reviews.

11. UPLOADING CONTENT & ACCEPTABLE USE
Your content:
– Retains your ownership rights;
– Grants MAKlistings.com a perpetual, global license to use/reproduce/distribute it.
Responsibilities:
– Secure/back up your content;
– MAKlistings.com may disclose your identity for IP/privacy claims;
– MAKlistings.com may remove non-compliant content.
Comply with our Acceptable Use Policy(https://MAKlistings.com/acceptable-use-of-policy/). You indemnify MAKlistings.com for breaches causing loss/damage.

12. MAKlistings.com’S ROLE REGARDING LISTINGS
MAKlistings.com:
– Has no obligation to monitor/approve Listings;
– Is not responsible for Listings;
– May remove non-compliant Listings.
Transactions: Purchases are directly between Buyers and Sellers.

13. LIABILITY
Business/Commercial Users:
– Platform provided “as is”;
– No liability for lost profits, business interruption, data loss, or indirect damages.
Personal Users:
– No commercial use permitted;
– Liability limited to foreseeable losses from MAKlistings.com’s breach.
Cap: MAKlistings.com’s total liability ≤ higher of:
(i) Fees paid for the relevant Paid Service; or
(ii) US Dollar 272.25.

14. BREACH OF TERMS & REPORTING
Breach: MAKlistings.com may suspend access, close Accounts, or take legal action.
Reporting:
– Illegal Content: Report to support@MAKlistings.com.
– IP Infringement: Notify support@MAKlistings.com. MAKlistings.com will remove infringing Content.

15. GENERAL
– Third-Party Links: For convenience only; no MAKlistings.com endorsement.
– Linking to MAKlistings.com: Link fairly/legally; MAKlistings.com may withdraw permission.
– Contact: support@MAKlistings.com (MAKlistings.com contacts via Account email).
– Viruses: Use protection; no bug-free guarantee.
– Force Majeure: Not liable for uncontrollable events (e.g., natural disasters, pandemics).
– Other Agreements: These Terms supplement other MAKlistings.com agreements. Conflicts favor these Terms.
– Governing Law: DIFC laws; DIFC courts have exclusive jurisdiction.
– Dispute Resolution: Contact support@MAKlistings.com first. Unresolved disputes proceed to DIFC courts.

16. ADDITIONAL TERMS & APPENDICES
The APPENDICES supplement these Terms. Conflicts favor the main Terms.
– Property for Sale/Rent: See Appendix 1.
– Motors: See Appendix 2.
– Jobs: See Appendix 3.
– Verified Business Account: See Appendix 4.

APPENDIX 1: PROPERTY FOR SALE/RENT
Owners must:
– Be the registered owner/landlord;
– Advertise only currently available properties.
Brokers/Agents/Developers must:
– Hold valid real estate licenses;
– Register “off-plan” properties.
Buyers/Renters acknowledge:
– MAKlistings.com is not a broker;
– MAKlistings.com does not verify Listings;
– Conduct independent due diligence.

APPENDIX 2: MOTORS
Sellers must ensure vehicles:
– Are roadworthy;
– Legally owned;
– Available for sale;
– Accurately described.
Proof: MAKlistings.com may request ownership/customs documents. Non-compliance = Listing removal.

APPENDIX 3: JOBS
Employers/Recruiters acknowledge:
– MAKlistings.com does not verify job seekers;
– “CV Search” is a tool only;
– Fees non-refundable.
Job Seekers acknowledge:
– Employers access your details/CV;
– Fees non-refundable.

APPENDIX 4: VERIFIED BUSINESS ACCOUNT
Effective Date: 1 November 2024
1. Feature: Display logo/business description/website link. Content must be accurate and compliant.
2. Subscription:
– Auto-renewal monthly unless canceled;
– Cancel anytime (access continues through current cycle).
3. Fees: Pay all applicable fees; non-payment may suspend access.
4. KYC: Provide valid business licenses.
5. No Guarantee: MAKlistings.com does not guarantee increased trust/visibility.
6. Changes: MAKlistings.com may modify/discontinue the feature with email notice.
7. Precedence: These terms prevail over conflicting main Terms.
